The following Terms of Use, together with all other policies referred to herein or in other documents, constitute the binding legal agreement (hereinafter the “Agreement”) between POSTWORK P.C., having its registered office in Athens, at 16 Kifisias Avenue, Postal Code 11526, Tax ID (ΑΦΜ) 801198034 and General Commercial Registry (Γ.Ε.ΜΗ.) No. 151552422000, or other companies affiliated with it (collectively hereinafter “we” or “Postwork”), and the users (hereinafter “you” or “User”) of the job search and recruitment website https://www.postwork.gr/ and of the corresponding mobile applications (mobile apps) owned and operated by Postwork (hereinafter the “Platform”). By registering on the Platform, whether as an employer or as a job applicant, you automatically agree to be bound by these Terms and by the relevant instructions of the Platform, its information and procedures, as well as by Postwork’s policies as in force from time to time.
1. General Platform Terms of Use
Postwork has sole authority to define the acceptable use of the Platform. If you download, access or use the Service on behalf of a third person or entity, you warrant and represent that you are authorized to accept this Agreement on behalf of such person or legal entity, and that such person or entity agrees to assume responsibility for the use of the Platform and the Service in accordance with this Agreement and to indemnify Postwork for any breach of this Agreement.
Postwork does not screen the User profiles contained in the Platform’s search results or in job applications. We cannot verify that Users are who they claim to be. Under no circumstances do we confirm the accuracy or completeness of any Job Offer or other information submitted by any User, including the identity of such User. Postwork assumes no responsibility and disclaims all liability for the content, accuracy, completeness, legality, reliability and availability of any Job Offer or other data and/or information available on the Postwork Platform.
Postwork does not endorse any prospective Employer or Job Applicant and makes no representation regarding the qualifications of any Employer or Job Applicant. In the event of a dispute between you and any Employer or Job Applicant, you undertake to indemnify Postwork for any damage arising from or connected in any way with such dispute (including covering Postwork’s legal costs in that case).
If you are an Employer, you acknowledge and agree that:
- your Job Offer (job vacancy / job post) will be accessible to other Users through the Platform. The job post remains active in accordance with the package you have selected.
- the Company offers the ability to publish an unlimited number of job posts. The use of these services is intended exclusively for good-faith and ordinary commercial use, in accordance with the terms and purpose of this platform. The notion of “unlimited” use may not be interpreted in a manner that results in abusive or excessive use of the Company’s resources, or in use incompatible with the nature of the services (for example: mass, automated, repetitive or fake job posts). The Company reserves the right to monitor the proper use of these users and, at its discretion, to temporarily or permanently restrict, suspend or even terminate access to the service where abusive or unfair use is identified. In the event of restriction or termination due to abusive use, no refund of amounts paid shall be provided.
- when you communicate with a Job Applicant (candidate) via chat, you share the information and content of your communication with Postwork, which you authorize to forward the communication and the information you share to the Job Applicant and also to store the conversation.
- to unlock communication with a candidate, you purchase credit packages. Each credit package is valid for a limited period of time. Upon expiry, any credits that have not been used expire automatically. If you already have active credits and purchase a new package, the expiry date of your existing credits is extended in line with the expiry date of the new package. By unlocking a candidate, you are able to contact them directly by phone or chat. Postwork shall not be held responsible if the candidate does not respond to any means of communication.
- For every job post, you are able to schedule online interviews with candidates. To schedule a new online interview, you send a request to the candidate, and the candidate must respond within 3 hours. If the candidate does not respond to the request, the request will be cancelled automatically. Each interview may not exceed 4 hours. You may schedule up to three (3) 4-hour interviews with the same candidate. Postwork is not responsible for any connectivity issue that may arise between the employer, the candidate and the platform.
- For every new job post, you are able to schedule an unlimited number of interviews at one of the addresses you have registered. To schedule a new interview at the company’s address, you send a request to the candidate, and the candidate must respond within 3 hours. Postwork assumes no responsibility in the event that the employer is not punctual as to the place/time of the interview.
- You represent and warrant that all information provided to us and contained in your Job Offer is true, accurate, complete and in no way misleading.
- You represent and warrant that all information contained in your company profile on the Platform is true, accurate, complete and in no way misleading.
- we have no control over the content of Profiles and, accordingly, Postwork is under no obligation to display any Profile and may block or remove any Profile from the Platform for any reason. Postwork assumes no responsibility and disclaims all liability for the content, accuracy, completeness, legality, reliability or availability of any Job Applicant on the Platform.
- if you delete your account, Postwork retains a record of your details for at least 6 months. After the 6-month period, all of your details are deleted from Postwork.
If you are a Prospective Employee, you acknowledge and agree that:
- any biographical details, information, dates, images, photographs, materials or application information that you post on your profile or otherwise make available through the Platform are subject to this Agreement. However, without limiting the foregoing, the creation of any Profile through the Platform automatically authorizes Postwork to share your Profile with any Employer.
- you acknowledge that both we and the Employers on the Platform rely on the accuracy and completeness of all information provided during your registration on the Platform, and you automatically represent and warrant that all information provided to us is true, accurate, complete and in no way misleading, and that it shall be kept so.
- Postwork is under no obligation to display any job post or to include any job listing in search results or other listings, and may block or remove any job post from the Platform for any reason.
- each Employer is responsible for any job post listed on the Platform. Postwork does not guarantee the validity of any job post; candidates must therefore verify the validity of any job post before taking any action that affects their current employment status.
- Postwork assumes no responsibility and disclaims all liability for the content, accuracy, completeness, legality, reliability or availability of any job post or of the information included in the Platform’s search results.
- if you delete your account, Postwork retains a record of your details for at least 6 months. After the 6-month period, all of your details are deleted from Postwork.
2. Creating a New Account
You will need to register on the Platform and create an account in order to access the Platform and use the Postwork Service. When registering on the Platform, you must provide your email address and your password.
You may create only one account on the Platform, by registering either (i) with your email address, or (ii) through your Google profile or a social media profile (Facebook, Apple).
We may also disclose User information where we believe that such Users are in breach of this Agreement or have used the Service to commit unlawful acts, or where such information is otherwise requested by the authorities and/or is necessary and/or appropriate.
By registering on the Platform, you agree (i) to provide true, accurate, current and complete information about yourself as requested by the registration form (including your email address, your Google account or your social media profile), and (ii) to be responsible for the security, confidentiality and use of your email and password, and not to transfer or resell the use of or access to your account, the Platform and the Service to third parties. Postwork bears no responsibility and disclaims all liability if your account or the means by which you log in to it (such as your email account) is misused or fraudulently used by a third party.
You agree to promptly update your account and other information, including your email address, mobile phone number and payment details where required, so that we can properly complete your transactions and contact you whenever necessary in connection with those transactions.
To protect your account, keep your account details and password confidential. You may not transfer or assign your Platform account to another user or entity. You are solely responsible for all activity that occurs on your Platform account.
If your account remains inactive for a period of 12 months, we reserve the right to close your account and terminate your access to the Platform.
Subject to any restrictions in the terms of use, you may close your Platform account at any time and for any reason. An essential precondition for closing your account is that there is no scheduled interview or active job post (if you are registered as an employer). To close your account, please also contact the Postwork support team at (support [at] postwork.gr).
If your Services are cancelled or your Platform Account is deactivated (whether by you or by us), your right to use our Services is terminated and your licenses expire immediately, whereupon we will delete the content associated with your Platform account.
3. Payment Terms
If you are an Employer, the Platform allows you to choose from a range of job posting packages and other services that may be offered by Postwork from time to time. Payment for the job posting service is made at the time of purchase.
If there is a charge associated with the use of the Platform or part of the Services, you agree to pay that charge in the specified currency (EURO). Depending on your location, some transactions may require conversion into a foreign currency or may be processed in another country. Your bank may impose additional charges for these services when you use a debit or credit card.
To pay the fees for a Service, you will be asked to provide a payment method at some point when you use the Service. By providing a payment method on the Platform, you (i) represent that you are authorized to use the payment method you have provided and that any payment details you provide are true and accurate, (ii) authorize Postwork to charge you for the Services using the payment method you have selected, and (iii) authorize Postwork to charge you for any paid feature of the Services that you choose to use. We may suspend or cancel the Services and charge compensation, additional administrative costs and interest if we do not receive full payment from you for all charges. Suspension or cancellation of the Services for non-payment may result in loss of access to and use of your account and the Service, including the Subscription Services and User Content.
All prices are exclusive of VAT (unless otherwise specified on the Platform) and are subject to change at any time.
All Services purchased are final and non-refundable.
4. User Content
The Platform allows Users to post, display and publish Job Offer listings, Profiles or any other information, images, messages and other materials. You acknowledge that, by accessing the Platform, you may come across content that may be considered inappropriate, and you acknowledge that Postwork shall bear no liability towards you for such content. Users may publish messages or statements in User Content that are misleading, deceptive or entirely false. Postwork is not responsible for any opinions, information and/or statements contained in content created or displayed on the Platform by Users.
Users are prohibited from posting any User Content that contains proprietary information, trade secrets or confidential information. Users must not post content or information that is unlawful, threatening, abusive, defamatory, obscene or otherwise objectionable, or that contains sexual, ethnic, racial or other discrimination, or material that lacks relevant or appropriate content, refers to abhorrent conduct or violates the law. You must comply with the User Content requirements determined solely by us. User Content may not contain advertisements, solicitations, pyramid schemes, investment opportunities or other unsolicited commercial communications, or any other form of encouragement or incitement to spamming.
Posting any User Content on the Platform that contains official identification details (whether your own or another person’s), such as a social security number, passport number, police identity card number, driving licence number or any other similar identification number or code, is prohibited. Including such identification information in any Profile may lead to identity theft and other adverse consequences, for which Postwork bears no responsibility. Postwork may remove such information from your Profile, but assumes no obligation or liability and disclaims all liability for the disclosure of such information on the Platform.
Although Postwork assumes no obligation to do so, it may review User Content posted on the Platform and reserves the right to delete any User Content, or part thereof, that violates the above rules or that Postwork, in its absolute discretion, considers inappropriate for display. If you believe that a message or a User’s Content in general violates our Policies, please contact Postwork immediately so that we can consider editing or removing it. Postwork does not undertake to remove any User Content, and the determination of whether User Content violates any of our Policies always remains at Postwork’s absolute discretion. Postwork reserves the right to disclose User Content and other relevant information, in circumstances warranting such disclosure, to any third party in order for the Platform to operate and provide the Services properly, to protect the legitimate interests of Postwork, its partners and the Users or visitors of the Platform, and/or to comply with its legal obligations or related requests.
5. User Content License
To the extent permitted by law, you grant Postwork an unlimited, non-exclusive, worldwide, unrestricted, irrevocable, fully paid-up, royalty-free license to use, reproduce, distribute, perform, display and generally process and exploit in any manner the User Content for any purpose related to the Platform, the Services and its business. You also grant Postwork and its affiliated companies the right to use your name in connection with the User Content. When you apply for a job through the Platform, you send your profile to Postwork and authorize Postwork to share that User Content with a third party and with employers. In addition, you represent and warrant that: (i) you own the User Content posted by you on or through the Platform, or you have the right to grant the license set out in this section, (ii) the User Content does not infringe the privacy rights, intellectual property rights or any other rights of any person or entity, and (iii) the User Content does not result in a breach of any contract between you and a third party. You agree to defend and indemnify Postwork and its affiliated companies against any claims arising from any content or material you provide on the Platform. You agree to pay all royalties, fees, damages and any other monies owed to any person or entity by reason of the content you post on or through the Platform.
If you wish to revoke the license granted for any User Content, please contact us at the support address mentioned above, enclosing a copy of your passport or police identity card (for identity verification purposes), and request the removal of that content. Your request must include: (i) the signature of the rights holder of the content in question or of a person authorized to act on behalf of the rights holder, (ii) identification of the content for which the license is to be revoked, together with information reasonably sufficient to enable Postwork to locate and remove the content from the Platform, (iii) your name, address, mobile phone number and email address, (iv) a statement that you have a good-faith belief that you are the rights holder or are authorized by the rights holder to revoke the license for the specified content, and (v) a statement that the information contained in the request is accurate and, under penalty of perjury, that you are the rights holder or are authorized to act on behalf of the rights holder with respect to those materials. A fee may be charged for responding to and executing such a request. Please contact Postwork for further information.
6. Intellectual Property Rights
Except for the limited licenses expressly granted to you in this Agreement, Postwork reserves for itself and its licensors all other rights, title and interest. By using our Services, you do not acquire any ownership rights in the Platform Content. The Platform Content remains our intellectual property, including (without limitation) source code, products, usage data, ideas, enhancements, requests, features, suggestions or other information provided by the Job Applicant or by any Employer. Postwork reserves all rights not expressly granted under this Agreement. Without limiting the foregoing, you may not reproduce, modify, display, commercialize or distribute the Platform Content, or use it in any other way for any purpose. You must not alter any copyright notices, proprietary titles, trademarks and trademark usage rights, patent markings or other indications of ownership on the materials you access through the Platform, other than User Content.
License for job applicants
Postwork grants you a revocable, limited, non-exclusive right to access and use the Platform solely for your personal use in seeking employment opportunities for yourself, provided always that you comply with the terms of this Agreement. Postwork reserves the right to suspend or revoke your right to use the Platform for any reason at any time, at its absolute discretion. You automatically agree that you are solely responsible for the content of any Profile you publish on the Platform and for any consequences arising from that Profile.License for employers
Postwork grants you a revocable, limited, non-exclusive right to access and use the Platform solely for you and your affiliated persons, for internal business use in searching for and finding candidates for employment, provided always that you comply with the terms of this Agreement. This allows you to access and use the material on the Platform solely for your own use directly related to searching for and recruiting prospective candidates. You may not sell, transfer or assign any of the Services or your rights to use the Platform, or any of the Services provided by Postwork, to you or to third parties without the express written authorization of Postwork. You agree that you are solely responsible for the content of any Job Listing you post on the Platform and for any consequences arising from your Profile and your listings.7. Representations and Warranties
You agree not to access (or attempt to access) the Platform and/or the Service by any means other than through the interface provided by Postwork, unless you have been expressly permitted to do so in a separate agreement with Postwork. You agree that you will not engage in any activity that interferes with or disrupts the Platform and/or the Service (or the servers and networks connected to the Platform). You agree that you are solely responsible (and that Postwork bears no liability towards you or any third party) for any breach of your obligations under this Agreement and for the consequences thereof, including any loss or damage that Postwork may suffer as a result of your breach. You agree that you will not reproduce, copy, sell, resell or otherwise exploit the Platform and the Service for any purpose.
You may use the Platform and any Services for permitted purposes and in accordance with applicable law. The distribution, storage or transmission of any unlawful material through the Platform and/or the Services is prohibited; otherwise, you may be exposed to civil and/or criminal liability. You agree that, if we receive a third-party claim that User Content you have created is unlawful or infringes third-party rights, you will undertake to do everything lawfully required to remedy the unlawfulness or infringement and, in addition, to indemnify Postwork for any damage it has suffered.
Certain features of our Services may be subject to additional terms and conditions, which you should read before using those features; such terms supplement this Agreement and form an integral part of it.
We reserve the right to refuse to provide, suspend or discontinue the Services, or to close your Account, in whole or in part, at any time for any reason, immediately and without notice. If we terminate your registration, or if we believe that you are in breach of this Agreement, without limiting our rights and legal remedies, you acknowledge and agree that you will not be entitled to any refunds or credits for any subscription periods and that we may immediately terminate your access to the Platform.
To use the Platform and access the services, you must have a computer, compatible mobile phone or portable device, internet access, data, and the minimum system and operating software requirements. You are responsible for providing all connections and/or equipment required to use the Services and for paying the fees charged by your connection and equipment providers. These fees are in addition to the fees you pay us for the Services, and we will not reimburse you for such fees.
You acknowledge that we are not required to keep the Platform available for your use, and we provide no warranties as to its availability or that the Platform will operate continuously or without errors. The Services may be unavailable from time to time, may be offered on a limited basis, or may vary depending on your region or device. We strive to keep the Services operational at all times. However, all online services may experience occasional disruptions and outages. Postwork is not liable for any disruption or loss you may suffer as a result of being unable to access the Platform or the Services. We assume no liability for the unavailability of the Platform, for any offer of services found on the Platform, or for any interruption or malfunction for any reason (including failures of the Internet service provider or the web hosting provider, third-party intrusions or force majeure). In the event of an interruption, you may not be able to recover your User Content.
You agree that you will not upload any harmful code to the Platform or use the Platform’s data for your own commercial gain. “Harmful code” means any software (often referred to as “viruses”, “worms”, “trojan horses”, “time bombs”, “time locks”, “drop dead devices”, “traps”, “access codes”, “cancelbots” or “trap door devices”) that (a) is intentionally designed to damage, disrupt, disable, harm, impede, interfere with, suspend, expropriate or in any way obstruct any data, storage media, program, system, equipment or communication, based on any event, including, by way of example but without limitation: i) exceeding a number of copies, ii) exceeding a number of users, iii) the passage of a period of time, iv) advancement to a specific date or other number, or v) use of a specific feature, or (b) would enable an unauthorized person to cause such a result, or (c) would enable an unauthorized person to access another person’s information without that other person’s knowledge and permission.
You will not copy any part of the Platform for your own commercial purposes, including: (i) reproducing or using the details and Profile of any User, (ii) reproducing in any way all or part of the Services or the Platform, (iii) using any “deep-link”, “robot”, “spider”, “page-scrape” or other automated device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any part of the Platform, the Profiles or any User Content, or reproducing or circumventing in any way the navigational structure or presentation of the Platform, or obtaining or attempting to obtain, by any means whatsoever, any documents or information not intentionally made available through the Platform, or (iv) incorporating all or part of the Platform into any other web page, website, platform, application or other digital or non-digital format.
In connection with any use of the Platform: (i) you must act responsibly, professionally, for the purposes of your professional activity and in good faith, (ii) you must refrain from discrimination, racism, and defamatory, inappropriate, obscene, offensive or other conduct that incites hatred, discrimination, racism, bigotry or physical violence against an individual or a group, (iii) you must treat the Platform and its Users with respect and must not engage in conduct that could be regarded as intimidation, harassment, degradation, insult or other offence (as determined by us), and (iv) you must not represent or promote unlawful or unethical activities.
Without limiting the above commitments, responsibilities and obligations, the following, by way of example, are not permitted:
The creation or facilitation of unsolicited commercial electronic messages (“spam”). Posting, sending, distributing, disseminating or displaying any unlawful, defamatory, harassing, abusive, fraudulent, illegal, obscene or otherwise inappropriate content. Impersonating another person (through the use of an email address or otherwise). The unlawful transmission of another person’s intellectual property or other proprietary information without the permission of the owner or licensor. The intentional distribution of any harmful code. “Pyramid” or promotional schemes. The transmission of content that may be harmful to minors, or of content that solicits or encourages the exchange of personal information with minors. Promoting or encouraging unlawful activity. Using the Platform in violation of the legal rights (such as the rights to privacy and personality) of others. Creating multiple User accounts in connection with any breaches of the Agreement, or creating User accounts by automated means or with false or fraudulent intent. Selling, reselling or otherwise exploiting for unauthorized commercial purposes, or transferring, any Platform account. Modifying, adapting or translating any part of the Platform. Infringing the copyrights, trademarks or other intellectual property rights contained in the Platform. Communicating with other Users of the Platform regarding marketing schemes, jobs that require payment in order to start, and any matters that Postwork considers detrimental to its users. Providing false information when using the Platform and/or the Service. Postwork reserves the right to use various methods to detect and address activity that does not comply with the terms of this Agreement, to monitor Users’ compliance with these terms and to prevent abuse (such as spam). These methods may sometimes result in the temporary or permanent suspension or termination of certain features for certain Users.8. Disclaimer
Except as expressly set out in this Agreement, POSTWORK makes no warranty and hereby disclaims all representations or warranties, express or implied, in relation to the Platform, any services and/or information available through any links (links) thereon, including any implied warranties of fitness for a particular purpose or use, as well as any warranties arising from any course of dealing, usage and/or trade practice. POSTWORK makes no warranty and disclaims liability for profiles, user content and job offer content, and is in no event responsible for the conduct or activity of any employer or job applicant.
POSTWORK makes no warranty and disclaims liability for the truthfulness, accuracy, content, completeness, legality, reliability, functionality or availability of the information or material appearing in the platform’s search results. POSTWORK makes no warranty and disclaims liability for the deletion, failure to store, or incorrect or untimely transmission of any information, communication or other material related to the service or the use of the platform.
POSTWORK makes no warranty and disclaims liability for any damage that may result from downloading or accessing any information or material on the platform. In no event is POSTWORK responsible for the use or misuse of the platform by any user.
The platform is provided by POSTWORK on an “as is” and “as available” basis. POSTWORK does not warrant that the users’ use of the platform will be uninterrupted or error-free, and POSTWORK offers no warranty regarding the use of the platform or the formation of any relationship or transaction between users, or regarding the provision of services by POSTWORK to users hereunder, including any warranties regarding the posting of a job offer or any results the user wishes to achieve under this agreement. The function provided by the platform, or its designated servers, is not that of an archive. Users are solely responsible for maintaining an independent record and copies of all information, including user content.
Because POSTWORK is not involved in transactions between users, if any dispute arises between one or more users, each user involved releases POSTWORK (and its partners and/or employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way connected with such disputes.
9. Limitation of Liability
In no event shall POSTWORK be liable for any indirect, incidental, consequential or special damages, or compensation of any kind or nature, arising from this agreement (including loss of profit or income, loss of opportunity, or harm to the user), even if POSTWORK has been advised of the possibility of such damages. This limitation applies to the maximum extent permitted by law.
Notwithstanding anything stated in this agreement, POSTWORK’s maximum liability is limited to the actual amount of any fee received by POSTWORK in connection with the specific service to which the claim relates.
10. Privacy and Data
You accept the Privacy Policy and agree that you will not do anything that contravenes the Privacy Policy or that would put Postwork and/or third parties at risk. We may amend the Privacy Policy at any time, at our absolute discretion, by posting the new terms on the Platform, and your continued use of the Platform automatically means that you accept such changes.
Each party (as applicable) represents and warrants that it has adopted and implements a privacy policy in accordance with the requirements of applicable law in relation to personal data provided to the other party in connection with the Services or otherwise under this Agreement. Without limitation, any necessary consent of a Job Applicant or other User must be obtained directly by any Employer for the purpose of facilitating the transaction between them and the better performance of the Service.
11. Confidentiality
The User agrees that it shall: (i) treat as confidential and maintain the confidentiality of all Confidential Information and not disclose it to third parties, (ii) use the Confidential Information solely for the purposes of this Agreement, and (iii) not copy such Confidential Information unless expressly authorized to do so by Postwork.
The obligations relating to Confidential Information shall not apply to any information that: (i) is already in the User’s possession, as evidenced by documents and without any obligation of confidentiality, (ii) is or becomes publicly available through no act or fault of the User, or (iii) the User received from a third party without that third party breaching any obligation of confidentiality. At Postwork’s request, the User must immediately return to Postwork, or destroy with proof thereof, all Confidential Information.
Without limiting the foregoing, the User shall not disclose the existence or terms of this Agreement or any other information regarding the Services in any advertising, promotional or sales activity, publicity or other public communication without Postwork’s prior written consent and approval, as the case may be. Postwork has the right to review and approve any press release, promotional/advertising material or related content that refers to Postwork.
12. Miscellaneous
No assignment of the Agreement shall be made without Postwork’s prior written consent. Any such attempted assignment or transfer shall be void, and Postwork may immediately terminate this Agreement and the User’s access to the Platform without liability. The User shall not use subcontractors for its operations under this Agreement without Postwork’s prior written consent.
Force Majeure. Neither Party shall be liable to the other for any failure to perform its obligations under this Agreement to the extent that such failure is due to a force majeure event, such as riots, embargoes, strikes or other collective labour actions, disasters, accidents or other causes, to the extent that such failure and its consequences are reasonably beyond the control of, and occur without the fault or negligence of, the Party invoking it.
Invalidity – Waiver. A finding that any part of this Agreement is invalid shall not affect the remaining parts of this Agreement. A waiver by either Party of a breach of any provision of this Agreement by the other Party shall not be construed as a waiver of any subsequent breach of the same or any other provision of this Agreement, nor shall any delay or omission by either party in exercising or enforcing any right or remedy operate as a waiver of any right or remedy.
Entire Agreement – Amendment. The parties agree that this Agreement is accepted electronically and that acceptance of these terms and conditions shall be validly formed and approved electronically. Postwork may amend the terms and conditions of this Agreement, and/or its policies and/or procedures, at any time by announcing the changes on the Platform. This Agreement constitutes the entire agreement between the parties with respect to its subject matter and supersedes and replaces all prior or contemporaneous agreements, written or oral, regarding that subject matter. Your continued access to and use of the Platform following such announcement shall be construed as your acceptance of the amendments made by Postwork. It is your responsibility to review the terms and conditions of this Agreement periodically for any changes. In certain cases, Postwork may, but is not obliged to, notify you of any changes to the Agreement. All notices provided by Postwork through the Platform, or any communications by email, fax or any other form of electronic communication from and between us, satisfy any legal requirement that such communications be made in writing.
Platform Operation. This Agreement and the Policies and procedures communicated through the Platform govern your use of the Platform. In the event of a conflict between any terms of this Agreement and any policies and procedures relating to specific programs that are communicated to you through the Platform, the program-specific policies and procedures shall prevail.
Relationship of the Parties. The Parties to this Agreement contract and operate independently of each other, and no other relationship shall be implied by this Agreement. Nothing contained in or done under this Agreement shall be construed as creating a partnership, agency or joint venture, and neither Party shall be bound by any representation, statement or act of the other Party. Each User assumes and is responsible for all expenses necessary to perform its obligations under this Agreement. We are not, and cannot be, a party to any transaction between any Job Offer and Employer, including any resulting employment or other engagement.
Ratings and Reviews. Postwork may use mechanisms that rate or review, or that allow Users to rate or review, other Users, and Postwork may make such ratings publicly available. Postwork shall bear no liability, and otherwise disclaims all liability, towards any User or third party for the content or accuracy of any rating or review. You shall have no ownership interest in, or license to use, any rating or review posted on the Platform, in which Postwork holds exclusive rights.
13. Use of AI on Postwork
AI is at the core of Postwork. Postwork bears no responsibility for the output of AI-generated text or for the AI-based analysis of job posts or of a candidate’s profile. The user accepts that the AI features are at a beta stage.
14. Governing Law and Jurisdiction
This Agreement shall be construed and performed in accordance with the laws of Greece. Users and Postwork agree that the courts located in Athens shall be the appropriate and exclusive forum for the resolution of any dispute relating to this Agreement and hereby consent to the personal and subject-matter jurisdiction of those courts.
